Provider-specific terms
Provider-Specific Terms for Atlassian's standard end-user agreement
Provider: Roshan Jahangir, a sole trader in the United Kingdom trading as Gherkit. Contact: support@gherkit.com.
1. Governing law and courts. This agreement is governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that either party may seek urgent injunctive relief in any competent court.
2. Data.
- The app runs on Atlassian's Forge platform and stores customer content only in the customer's Atlassian site (Jira issue properties and Forge storage).
- The app does not send Customer Data to the Provider, and the Provider does not host it.
- The Provider will sign a data processing agreement on request.
- If the Customer sends personal data to the Provider in a support request, the Provider handles it as described in the Gherkit privacy policy.
3. Support.
- Support is by email at support@gherkit.com.
- The Provider aims to reply within two UK business days.
- No service level is guaranteed beyond the commitments in the Marketplace listing.
4. Changes and end of life.
- The Provider may change the app's features.
- If the Provider decides to stop offering the app, it will give at least 90 days' notice by email to the technical contact on the licence, where available, and on the Marketplace listing.
- Customers can export all scenarios as
.featurefiles at any time, and the data stays in their Jira issue properties.
5. Liability. The Provider's total liability under this agreement is limited to the greater of (a) the fees the Customer paid for the app in the 12 months before the claim and (b) £100. This limit does not apply where the law does not allow it. Where the standard agreement sets a different cap, the standard agreement prevails unless these terms expressly override it.
